Welcome to LandShark Carts ("we," "our," or "us"). By using our services, renting our golf carts, or accessing our website (https://www.landsharkcarts.com), you agree to the following Terms and Conditions. Please read them carefully.
1. Rental Agreement
1.1 Eligibility: Customers ("you" or "rider") must be at least 18 years old and possess a valid driver’s license to rent or operate a golf cart.
1.2 Rental Period: Rentals are subject to the agreed-upon duration specified in the rental agreement. Late returns may incur additional fees.
1.3 Usage Restrictions: Carts may only be used in designated areas. Off-road use, reckless driving, or violation of traffic laws is prohibited and may result in penalties or termination of the rental agreement.
2. Safety and Compliance
2.1 Driver Responsibility: You are responsible for operating the golf cart safely and adhering to all local traffic laws and regulations.
2.2 Passenger Limit: Do not exceed the cart’s designated seating capacity.
2.3 Prohibited Activities: Consumption of alcohol or drugs while operating the golf cart is strictly prohibited.
3. Payment and Fees
3.1 Payment Terms: All rentals must be paid in full before the rental period begins. Accepted payment methods include credit/debit cards and other payment options specified on our website.
3.2 Security Deposit: A refundable security deposit may be required. The deposit will be returned after the cart is inspected for damage.
3.3 Late Fees: Failure to return the cart on time will result in additional charges as outlined in the rental agreement.
3.4 Damage Charges: You are responsible for any damage, loss, or theft of the cart during the rental period. Applicable repair or replacement costs will be deducted from the security deposit or charged separately.
4. Liability and Insurance
4.1 Personal Liability: LandShark Carts is not responsible for any injuries, accidents, or damages resulting from the misuse or improper operation of the golf cart.
4.2 Insurance: Customers are encouraged to carry personal insurance to cover liability and damages. Limited liability coverage may be included with the rental; please refer to your rental agreement for details.
4.3 Indemnification: You agree to indemnify and hold LandShark Carts harmless from any claims, damages, or liabilities arising from your use of our carts.
5. Cancellations and Refunds
5.1 Cancellations: Cancellations must be made at least 24 hours before the rental period for a full refund. Late cancellations may be subject to fees.
5.2 Refunds: Refunds will not be issued for early returns or unused rental time.
6. Privacy and Data Collection
6.1 Data Use: By using our website or services, you consent to the collection and use of your personal data in accordance with our Privacy Policy.
6.2 GPS Tracking: Golf carts may be equipped with GPS tracking for safety, theft prevention, and operational purposes. By renting a cart, you consent to this tracking.
7. Prohibited Conduct
7.1 Tampering: Do not tamper with, modify, or disable any equipment, including GPS trackers, installed on the carts.
7.2 Unauthorized Use: Sub-renting, lending, or using the cart for commercial purposes without prior authorization is prohibited.
8. Termination of Service
LandShark Carts reserves the right to terminate rentals and refuse service to customers who violate these terms or engage in unsafe or illegal activities.
9. Dispute Resolution
9.1 Governing Law: These Terms and Conditions are governed by the laws of the state where the rental occurred.
9.2 Disputes: Any disputes will be resolved through arbitration or small claims court, as agreed upon by both parties.
10. Amendments
LandShark Carts reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of the revised terms.
